The matters abovementioned have been filed by M/s. Gagrat & Co., Advocates on behalf of the Petitioner against the Judgement and Final Order dated 1 st August, 2014 of the High Court of Judicature for Rajasthan at Jodhpur in D.B. Civil Writ Petition Nos. 3243, 3233 and 3236 of 2014.

It is submitted that SLP © Nos. 1470614710 of 2014 between same parties arising out of similar issue was listed before the Hon'ble Court on 3 rd June, 2014 when the Court was pleased to dismiss the same as withdrawn. Copy of the record of proceeding dated 3rd June, 2014 is enclosed herewith.

It is further submitted that counsel for the petitioner has on 6 th August, 2014 filed application for permission to file additional documents alongwith additional documents (Volume – II) and the said applications have been registered as I.A. Nos. 4 to 6. The said documents are being circulated herewith.

The matters abovementioned were mentioned before the Hon'ble Court on 7 th August, 2014 when the Court was pleased to pass the following order:

"Taken on Board.

Issue notice to the respondents, returnable on 14.08.2014, to show cause as to why cost should not be imposed on the respondents for unnecessarily opposing the adjournment sought by the petitioner during the proceedings before the High Court.

Mr. Puneet Jain, Advocate appears and accepts notice on behalf of the respondents. Liberty is given to the respondents to tender their explanation by way of an affidavit.

Interim order subsisting before the passing of the impugned order is revived. In the meantime, attachment orders shall remain stayed."

It is submitted that there are five common respondents in the said SLPs. Respondent Nos. 1 to 4 are represented through Ms. Pratibha Jain, Advocate. Show cause notice was issued to respondent No. 5 through speed post only on 12th August, 2014. Service of notice is awaited. Counsel for respondent Nos. 1 to 4 has on 12th August, 2014 filed reply affidavit. Copy of the same is being circulated herewith.

The matters are listed before the Hon'ble Court with this office report. Dated this the 13th day of August , 2014.
