UPON hearing the counsel the Court made the following O R D E R
We have perused the affidavit filed by Shri Prateek Hajela, State Coordinator, NRC, Assam, pursuant to the order of this Court dated 20th August, 2014. We have
considered the Time Schedule mentioned in the said affidavit for completion of the work of updating the NRC. We have also taken note of the progress made till date which has been outlined in detail in the affidavit filed by the State Coordinator.
At this stage, the Court would only like to observe that there is scope for compressing the Time Schedule indicated in the affidavit of the State Coordinator so that the process of completion of the final updated NRC is advanced to a point of time earlier than what has been indicated. In fact, the Court is of the view that the different stages of the process, as indicated, can be suitably combined and work thereunder can be carried out simultaneously. We, therefore, direct the State Coordinator to submit to the Court a revised Schedule so as to advance the completion of the publication of the final/ updated NRC within an outer limit of 18 months from today.
Having regard to the nature of the work that is involved in the process of upgrading the NRC, we direct the State Coordinator to submit a report to the Court in a sealed cover indicating the further steps and measures that
are required to be taken in his considered view to facilitate the work in question and also the difficulties, if any, that he anticipates in the smooth execution of the work of updating the NRC.
The above information will be laid before the Court by the State Coordinator without any consultation with any Authority whatsoever and without reverting to the State Government or any Authority in the Union Government. Needless to say, the information that would be laid before the Court by the State Coordinator will remain absolutely confidential and may serve as additional inputs/materials in assisting the Court, as may be required, from time to time.
The revised Time Schedule as well as the note of the State Coordinator in sealed cover in terms of the present order will be submitted on or before 8th October, 2014. The aforesaid Note in sealed cover will be handed over to the Secretary General of this Court and will remain in sealed cover until otherwise ordered by the Bench. The matter will be considered on 16th October, 2014.
List the matters on 16th October, 2014. On the said day, the Writ Petition (Civil) No.562 of 2012 will also be considered.
