The matter above mentioned was listed before the Hon'ble Court on 15th January, 2016, when the Court was pleased to pass the following Order: "Heard the learned counsel for the petitioner and perused the relevant material. Delay condoned.

Exemption from filing certified copy of the impugned judgment and O.T. is granted.

Permission to file additional documents is granted.

Issue notice.

Status quo with regard to property, as on today, shall be maintained by the parties. Mr. Arvind S. Avhad, Advocate-on-record accepts notice on behalf of respondent No.1 and prays for three weeks' time to file counter affidavit. Three weeks' time as prayed for is granted to the learned counsel for the respondent No.1 to file counter affidavit. "

And lastly, the matter above mentioned was listed before the Court of Registrar

on 26th August, 2016, when the following Order was passed:

"Respondent No.1 has already filed the counter affidavit. Respondent No.5 has not filed counter affidavit, despite last opportunity having been granted. Further opportunity is declined. Four weeks' time, as last opportunity, is granted to respondent Nos.2 to 4 for filing counter affidavit. Registry to process the matter for listing immediately thereafter before the Hon'ble Court, irrespective of the fact whether counter affidavit by respondent Nos.2 to 4 is filed or not."

It is submitted for the information of the Hon'ble Court that there are five respondents in the instant matter. Accordingly, show cause notice was issued to all the respondents by registered A. D. post. Mr. Arvind S. Avhad, Advocate has filed

vakalatnama/appearance and affidavit in reply on behalf of respondent No. 1. Counteraffidavit has been included in the paperbooks. Mr. Nishant R. Katneshwarkar and Ms. Aparna Jha, Advocates have filed vakalatnama/appearance on behalf of respondent Nos. 2 to 4 and 5 respectively but they have not filed counteraffidavit so far.
