The Writ Petition above-mentioned was listed before the Ld. Registrar's Court on 03.12.2014 with Office Report dated 02.12.2014, when he was pleased to pass the following Order:-
"The respondent No.1 shall file the counter affidavit within a period of four weeks.
Fresh steps for the service of notice by usual mode to the unserved respondent No.2 shall be taken by the Ld.counsel for the petitioner within a period of three weeks. Dasti in addition is permitted to be served through the Ld.Standing counsel representing the State of J & K.
List again on 17.02.2015."
Pursuant to aforesaid Order, it is submitted that Show Cause Notice was issued to Respondent No. 2 on 17.12.2014 through Registered A.D as well as Dasti through the Ld. Standing counsel representing the State of J & K.
It is further submitted that neither A.D. Card nor unserved cover containing the Notice has been received back in respect of Respondent No. 2 so far.
It is further submitted that Mr. Rameshwar Prasad Goyal, Advocate for the petitioner has not filed Proof of Dasti Service of serving Show Cause Notice upon Respondent No. 2, so far.
Hence, Service of Show Cause Notice is incomplete in respect of Respondent No. 2.
It is lastly submitted that Ms. Sushma Suri, Advocate for Respondent No. 1 has not filed Counter Affidavit, so far.
The Writ Petition above-mentioned is listed before the Registrar's Court with this Office Report for orders.
