UPON hearing the counsel the Court made the following O R D E R

We have heard Mr R Basant, senior counsel appearing on behalf of the petitioners, and Mr G Arudhra Rao, counsel appearing on behalf of the second respondent.

  • 2 We are not inclined to interfere with the impugned order of the High Court of Judicature at Madras dated 25 July 2022, by which the High Court has declined to set aside the order of the Magistrate directing an investigation under Section 156(3) of the Code of Criminal Procedure 1973. However, having regard to all the facts and circumstances, we order and direct that the petitioners shall be at liberty to surrender before the competent court within a period of four weeks and to apply for regular bail. The application for bail shall be considered by the Magistrate on the same day on which it is filed.
  • 3 All the rights and contentions of the parties are kept open.
  • 4 Subject to the aforesaid directions, the Special Leave Petitions are disposed of.
  • 5 Pending application, if any, stands disposed of.
