O R D E R

Pursuant to various orders passed to consider extending benefits to fresh incumbents, the State Government has formulated a Scheme vide order dated 22nd October, 2017, a copy whereof is placed on record. The order is extracted hereunder:

"GOVERNMENT OF ODISHA

SCHOOL AND MASS EDUCATION DEPARTMENT

ORDER

In exercise of the powers conferred by sub-section (4) of section 7-C of the Odisha Education Act, 1969 (Odisha Act 15 of 1969), the State Government do hereby make the following Order to regulate the payment of grant-in-aid to Private Educational Institutions (being High Schools, Upper Primary (ME) Schools, Sanskrit Tols and Madrasas), namely:-

1. Short title and commencement-(1) This order may be called the Odisha Education (Payment of Grant-in-Aid to the High Schools, Upper Primary (ME) Schools, Sanskrit Tols and Madrasas) Order, 2017.

(2) It shall come into force with effect from the 1st January, 2018.

2. Applicability.-Subject to the provisions of this Order, it shall apply to the employees who are governed under the provisions of the Odisha Education (Payment of Grant-in-Aid to the High Schools, Upper Primary (M.E.) Schools, Sanskrit Tols and Madrasas Order, 2013.

3. Entitlement.-(1) The employees covered under sub-para (a) of Para-5 of the Order referred to in Para-2 who are receiving Grant-in-Aid as on the 31st December, 2017, shall subject to such conditions as may be imposed, be eligible to receive Grant-in-Aid which is initial Pay plus Grade Pay as applicable to such employees as per the Odisha Revised Scales of Pay Rules, 2008 (hereinafter referred to as the ORSP Rules, 2008) and Dearness Allowance at the rate of 136 per centum and the Pay shall be fixed by allowing one increment notionally for every completed three years of service for the period from the date of receipt of such Grant-in-Aid by him till the 31st December, 2017 as per the ORSP Rules, 2008.

(2) The employees referred to in sub-para (1) of Para-3 shall also be entitled to annual increment on each completed year of service after the 1st day of January, 2018; the first shall be due on the 1st January, 2019.

(3) The Dearness Allowance shall be payable as admissible from time to time.

4. Payment of Grant-in-Aid.-Payment of Grant-in-Aid for all categories of Institutions shall be subject to the following stipulations, namely:-

(a)No Grant-in-Aid shall be paid for a post, if that post is held by a person who is not qualified to be appointed in that post or does not possess the minimum qualification prescribed for that post at the time of his appointment.

(b) In computing the period of eligibility for release of Grant-in-Aid at different rates, the period for which the relevant post remained vacant or was held by an under qualified/ineligible person shall be excluded.

(c) No Grant-in-Aid shall be payable to an institution which has not achieved such minimum enrollment as prescribed under clause (3) of section 11 of the Act in respect of High Schools and for different Educational Institutions for different areas as prescribed by Government from time to time.

(d) No Grant-in-Aid shall be payable to an educational institution which has failed to present candidates less than such minimum enrollment as prescribed under clause (3) of Section 11 of the Act in the Annual HSC examination conducted by the Board of Secondary Education.

(e) No Grant-in-Aid shall be payable to an educational institution located in non-scheduled areas which has failed to achieve half of the percentage of students passing such examinations for the entire Board for consecutive three years. Similarly in respect of Schools located in scheduled areas the percentage of students passing the Annual and Supplementary Examination conducted by the Board of Secondary Education, Odisha shall not be less than half of the District average of the District in which the School is located for consecutive three years.

Certain Annexures form part of the aforesaid order, issued by the Government of Odisha, School and Mass Education Department.

We find that those, who want to benefit by this Order have to comply with the conditions mentioned therein and those, who still want to question it and want to agitate their independent rights are free to do so in accordance with law, before the appropriate forum.

In view of the aforesaid observation, all the petitions and applications stand disposed of.

We place on record our appreciation to the efforts made by learned counsel appearing on behalf of State of Orissa in suggesting to the State Government the solution that has been worked out for giving benefit to a large number of incumbents.

It is made clear that we have not diluted our consent orders passed earlier with respect to incumbents it was passed, it holds good.
