The matter above mentioned was listed before the Hon'ble Court on 17.08.2016, when the Court was pleased to pass the following Order:
"Delay in filing the special leave petition is condoned subject to payment of Rs.1,000/, as costs, with the Supreme Court AdvocatesonRecord Welfare Trust, within four weeks from today. Subject to compliance of the said condition, let notice be issued to the respondent."
It is submitted that Counsel for the Petitioner had deposited the cost of Rs. 1000/ with Supreme Court Advocateonrecord Welfare Trust on 20.08.2015 and filed proof thereof on 21.08.2016. Accordingly Show Cause Notice was issued to the sole Respondent through Regd. A.D. Post on 07.09.2015, which was received unserved with postal remarks insufficient address.
Thereafter, the matter abovementioned was listed before the Court of Registrar on 01.03.2016, when the following Order was passed:
"Fresh steps for service of sole respondent be taken within two weeks time. Notice thereafter, be issued. List again on 29.06.2016."
It is submitted that Counsel for the Petitioner did not take fresh steps in respect of sole respondent, hence the matter abovementioned was listed before the Court of Registrar on 29.06.2016 and when again listed on 04.08.2016, the following Order was passed:
"Despite last opportunity granted, fresh steps for service of sole respondent have not been taken.
Let the matter be placed before the Hon'ble Judge in Chambers for further directions."
It is submitted that Counsel for the Petitioner has still not take fresh steps in respect of sole respondent wherefrom Show Cause Notice was returned unserved with postal remarks 'insufficient address'.
The Office Report for Directions in matter abovementioned is, therefore listed before the Hon'ble Judge in Chambers.
