The matter above mentioned was listed before the Hon'ble Court on 31.08.2015 when the Court was pleased to pass the following order :

" Learned Senior Counsel appearing for the Petitioner, on instruction from the Petitioner who is present in Court, states that the Petitioner is unable to comply with the Impugned Order which fixes the mesne profit at Rs. 15,000/ p.m. (Rupees Fifteen Thousand only). It is in these circumstances that he prays that the Petitioner may be permitted 18 months' time to vacate the suit premises and that in that period Petitioner will pay Rs.5,000/ p.m. as mesne profits.

Issue notice returnable in two weeks."

It is submitted that accordingly show cause notice was issued in respect of sole respondent. Mr. Jayant K. Mehta, Advocate has filed Vakalatnama & memo of Appearance on behalf of sole respondent but he has not filed Counter Affidavit so far.

It is further submitted that counsel for the petitioner has filed an application for condonation of delay in filing Valuation Affidavit and court fee of Rs. 600/ which is registered as IA No.1 and being circulated with this office report.

The matter is listed before the Hon'ble Court with this office report.
