The matter above mentioned was listed before the Hon'ble Court on 18.7.2016 when the Court was pleased to pass the following order :

" Learned counsel for the petitioner agrees to vacate and handover possession of the trusted premises within the next seven months and that for the said period, he will pay mesne profits at the rate of Rs.5000/ per month.

Petitioner is already stated to have paid a sum of Rs.1,00,000/ (Rupees one lac only) towards arrears, as agreed between the parties.

Petitioner is directed to file an affidavit of undertaking to vacate and handover peaceful possession of the premises without creating any third party interests within next seven 2 months.

Such affidavit shall be filed within ten days.

The special leave petition is disposed of. Pending application(s), if any, shall stand disposed of. "

It is submitted that as per aforesaid order, Mr. Saurabh Mishra, counsel for the petitioner has on 12.8.2016 filed an Affidavit of undertaking alongwith an application for condonation of delay in filing the same. There is a delay of 15 days in filing affidavit of undertaking. The said application is registered as I.A No.3 and being circulated before the Hon'ble Court.

The application above mentioned is listed before the Hon'ble Court with this office report.
