UPON hearing the counsel the Court made the following O R D E R

Permission to file special leave petition is granted.

Heard counsel for the petitioner.

Identical issue came up for consideration in Special Leave Petition (C) No.12683 of 2020, which has been disposed of finally in terms of order dated 28th October, 2020. Since the issue is identical, we proceed to pass the same directions, namely, the election programme in respect of Town Panchayat, Kottur, Bellary District may proceed until the stage of counting. But the final result of the elections shall not be declared until the pronouncement of final judgment by the learned Single Judge of the High Court in the pending Writ Petition No.148217 of 2020.

All contentions available to the parties are left open to be decided uninfluenced by the impugned judgment and order.

We request the High Court including the learned Single Judge to dispose of the aforementioned writ petition expeditiously, preferably within one month from today, keeping in mind that the subject matter is in respect of election pertaining to Town Panchayat.

Special Leave Petition and pending application are disposed of accordingly.

Copy of this order be forwarded to the Returning Officer and Secretary, Urban Development Department, State of Karnataka through e-mail for information and necessary action.
