UPON hearing counsel the Court made the following O R D E R

Mr. P.H. Parekh, learned Senior Counsel, appeared for Petitioner and Mr. Mahabir Singh, learned Senior Counsel, appeared for alleged Contemnor/s. Vide order dated 24.07.2012 passed by this Court, Dr. K. I. Askari, alleged Contemnor No.2/Respondent No.2, is present today.

The alleged Contemnor No.2/Respondent No.2 (Dr. K.I. Askari) makes a categorical statement today before us that there was some confusion earlier which has been sorted out now and he along with the other Alleged Contemnor No.1/Respondent No.1, even on earlier dates, was ready and willing to give peaceful vacant possession of land admeasuring 500 sq.yds. to the Petitioner and even today, they are ready and willing to do so. He further states that today itself Petitioner can go on the spot and take possession of land admeasuring 500 sq.yds. as has been marked in red colour in the Map appended to the Compromise Decree passed by this Court vide its order dated 29.02.2012.

In this view of the matter, Petitioner is directed to take possession of land admeasuring 500 sq.yds. marked in red colour in the Map today itself at 4 P.M. and report the matter tomorrow i.e. 01.08.2012.

List the matters on Wednesday, the 1st August, 2012.
