C.A.Nos.8439-8440/2014 :
Ms. Anitha Shenoy, learned Advocate-on-Record,8439 waives notice for Respondent No.3. At the request of the learned counsel for the appellants, Respondent Nos.4, 5 and 6 stand deleted at the risk and cost of the appellants. No interim relief at this stage and looking at the facts of the case, hearing is fixed on 11th February,2015. If it is not heard, the issue with regard to the interim relief shall be decided on that date. C.A.Nos.10413-10414/2014 : Ms. Anitha Shenoy, learned Advocate-on-Record, waives notice for Respondent No.3 to 8. At the request of the learned counsel for the appellants, Respondent Nos.9 to 12 stand deleted at the risk and cost of the appellants. List the matters on 11th February, 2014."
It is submitted that there are six respondents in Appeal no. 8439 and seven respondents in Appeal no. 8440 of 2014. M/S S.M. Jadhav & Co, Advocates has entered appearance for common respondent no. 1 in both the matters. Ms. Anitha Shenoy, advocate has not filed vakalatnama for common respondent no. 3 in both the appeals. Certificate of service is awaited from Tribunal for common respondent no. 2 in both the appeals. Certificate of service in respect of respondent no. 7 in Appeal no. 8440 of 2014 has been received with remarks "Refused." . Respondent nos. 4 to 6 are deleted in view of the above said orders.
It is further submitted that Counsel for the respondent has on 04.12.2015 filed an amended bank guarantee for Rs. 67,60,38,231/ (Rupees Sixty seven Crores Sixty Lacs Thirty eight thousand two hundred and thirty one only/) bearing maturity up to 13112017 in view of the Hon'ble court's order dated 15.05.2015 and 24.07.2015.
Civil Appeal No. 1041314 of 2014
The matter above mentioned was listed before Hon'ble Court on 17th November,2014 when the Court was pleased to pass the following order:
"Delay condoned. Admit. To be heard along with Civil Appeal Nos.8439-8440 of 2014. All these appeals are to be notified on 28th November,2014, instead of 24th November, 2014, as requested by the learned counsel for the appellant as well as the learned counsel for the respondents."
It is submitted that there are 11 respondents in Appeal no. 10413 and 12 respondents in Appeal no. 10414 of 2014. Respondent no. 1 in both the appeals is represented by Shivaji M. Jadhav, Advocate.Ms. Anitha Shenoy, advocate has not filed vakalatnama for respondent no. 5 and 7 in both the appeals. Mr. Tushar Bakshi, Advocate has entered appearance for respondent nos. 3 ,4 ,6 and 8. Respondent nos. 9 to 12 are deleted vide Court's order dated 28.11.2014.
Counsel for the respondent has not filed any Bank Guarantee in view of the Hon'ble court's order dated 15.05.2015 and 24.07.2015.
Civil Appeal No. 1650 of 2015
The matter above mentioned was listed before Hon'ble Court on 06th April,2015 when the Court was pleased to pass the following order:
"Admit.
Tag with Civil Appeal Nos. 8439-40 of 2014."
It is submitted that NLPA has been issued to all the ten respondents through Tribunal. Mr. V.N. Raghupathy and Tushar Bakshi have entered appearance on behalf of respondent nos. 1 and 5. Certificate of Service in respect of respondent nos. 2 to 4 and 6 to 10 are awaited from the Tribunal.
Counsel for the respondent has not filed any Bank Guarantee view of the Hon'ble court's order dated 15.05.2015 and 24.07.2015.
