O R D E R
The only ground on which the delay of 1477 days in filing the Appeal against the impugned order dated 22nd May, 2010 and the order in review dated 3/12/2010 was not condoned was that another person had in fact filed an appeal against the review order. This is though, admittedly, the said review order was communicated to the appellant only on 19th December, 2013 i.e. a period of over three years from the date of the passing of the impugned order. We find that sufficient cause to condone this delay has, in fact, been made out on the facts of this case. As a result, we set aside the order dated 23rd May, 2014 passed by the Appellate Tribunal for Electricity and restore the Appeal to the file which shall be heard on merits.
The appeal stands disposed of.
