Having gone through the order passed by the learned Magistrate summoning the petitioner/accused and the impugned judgment and order passed by the High Court, we see no reason to interfere with the impugned judgment and order passed by the High Court in exercise of powers under Article 136 of the Constitution of India. The Special Leave Petition stands dismissed.
However, it is observed that the defences which may be available to the accused are kept open to be considered by the learned Trial Court at the time of trial.
