The matter above-mentioned was listed before the Hon'ble Court on 17.10.2016 when the court was pleased to pass following order:

"As per tracking report notice issued to the respondent Nos. 1 to 9, 12, 14 to 16 and 18 have been received back without any remarks. Hence, learned counsel for the petitioners shall within a period of four weeks file the fresh particulars of the said respondents and he shall also take fresh steps for the service of notice to them within the same period.

Await the return of the service of notice already issued to the respondent Nos. 22 and 27.

Mr. Ankit Acharya, Ld. Advocate has appeared on behalf of the respondent Nos. 10, 11, 13, 17 and 19 to 21. He seeks and is given two weeks time to file the vakalatnama and four weeks to file the counter affidavit.

List again on 21.11.2016."

It is submitted that counsel for the petitioner has on 08.11.2016 filed spare copy on behalf of the unserved respondent Nos. 1 to 9, 12, 14 to 16 and 18 but he has not filed fresh particulars of the said respondents. Hence, notice could not be issued to the unserved respondents.

As per track report "item received" at "Parbatsar" in respect of respondent No. 22.

It is further submitted that track report of respondent No. 27 (i.e. CD 258171667IN ) is not found in the website of India Post.

It is further submitted Mr. Ankit Acharya, Advocate who has appeared on behalf of the respondent No. 10-11, 13, 17 and 19-21 has not filed vakalatnama/memo of appearance and counter affidavit on behalf of the said respondents.

Service is not complete in respect of respondent Nos. 1-9, 12, 14-16,18 & 27.

The matter above-mentioned is listed before the Hon'ble Court with this office report.
