UPON hearing the counsel the Court made the following O R D E R

The dispute in this petition for Special Leave to Appeal is over the elections of the office bearers and members of the Executive Committee of the Basketball Federation of India. The petitioners assail an order of the Division Bench of the Delhi High Court passed on 1st June, 2023. This order records:

"It has been brought to the notice of this Court that a Special leave Petition vide diary No.20299/2023 has been filed in the Hon'ble Supreme Court challenging the judgment dated 02.05.2023, passed in W.P.(C)No.1982/2023, which is also under challenge in the present LPA.

In light of the aforesaid, the hearing of the present matter is deferred to 11.08.2023."

On the same dispute, another petition for Special Leave to Appeal registered as Diary No.20299 of 2023 is pending before this Court. Mr. Siddhartha Dave, learned senior counsel appearing for the petitioners, on instructions, undertakes before this Court that his clients would not prosecute that Special Leave Petition.

The main grievance of the petitioners, so far as the impugned order passed by the High Court is concerned, is over deferring of hearing of the matter to 11th August, 2023. Otherwise, we do not find there is any reason for being aggrieved over this order.

This being the position, we are of the view that the petitioners ought to approach the High Court for fixing an early date of hearing or seek any other relief in the matter. We are giving this liberty to the petitioners as it is submitted before us that urgent interim relief is required in these matters.

In view of the above, the Special Leave Petition stands disposed of.

Pending application also stands disposed of.
