UPON hearing the counsel the Court made the following O R D E R

I.A. No.48298/2020 & 52332/2020 in S.L.P.(C) No.10135/2019

  • 1 By the order of this Court dated 5 March 2020, TSIIC was directed to deposit by 30 April 2020 an amount of Rs 69.30 crores, together with interest at the rate and in the manner directed by the order of the learned Single Judge of the High Court. Neither the principal nor the interest has been deposited. However, certain difficulties have been pointed out in the interim applications filed for extension of time. These difficulties were reiterated in the submissions of Mr C S Vaidyanathan, learned senior counsel appearing on behalf of TSIIC.

  • 2 The applications have been opposed by Ms Anubha Agarwal, learned counsel appearing on behalf of the new management of Unitech Limited.

  • 3 Sufficient time was granted, in terms of the statement made before this Court, by TSIIC to effect deposit. Over five weeks have elapsed since time expired. However, in view of the difficulties which have been placed before the Court, we direct that the entire principal amount be deposited as directed in the previous order dated 5 March 2020, within a period of four weeks from today and the interest be deposited on or before 31 July 2020. No further extension of time will be granted. TSIIC is placed on notice that consequences may follow in the event of any further default.

  • 4 The interlocutory applications for extension of time are accordingly disposed of.

  • 5 List the Special Leave Petitions in the second weeks of August 2020.
