For Respondent(s)

UPON hearing the counsel the Court made the following O R D E R

These writ petitioners are aspirants for admission for undergraduate medical courses. They have appeared in the NEET (undergraduate-2020). The OMR sheets were uploaded by the NTA on 5.10.2020 and the petitioners were surprised to see that the OMR sheets do not tally with the actual answers given by them.

We are informed that a representation has been preferred by a few petitioners for supply of original OMR sheets to them for verification. This Writ Petition is

filed for issuance of several directions including appointment of a High-Powered Committee to examine the complaint regarding the tampering of the OMR sheets, setting aside the notices dated 27.09.2020 and 5.10.2020 by which procedure was prescribed for challenging the answer key and OMR sheets and for quashing the NEET results which have been uploaded on 16.10.2020.

More than 15 lakh students have taken the undergraduate examination for the academic year 2020-2021 and even the second round of counselling has been completed. The grievances of individual students cannot be addressed by us in a petition filed under Article 32 of the Constitution of India. However, NTA shall consider the representation preferred by some of the petitioners for furnishing the original OMR sheets. Any further grievance of the petitioners relating to the procedure prescribed for challenging the answer key and the OMR sheets can be raised by filing a Writ Petition under Article 226 of the Constitution of India.

The writ petition is accordingly, disposed of. Pending application(s), if any, shall stand disposed of.
