The matter above mentioned was listed before the Hon'ble Court on

14th November, 2014 when the Court was pleased to pass the following Order:

"Issue notice. Mr. Rajan Narain, Advocate takes notice on behalf of the respondents. Counter affidavit be filed within four weeks. Rejoinder, if any, be filed within two weeks thereafter. List after six weeks."

And lastly, the matter above mentioned was listed before the Ld. Registrar

Court on 5th January, 2015 when the following order was passed :

"What gets revealed from the perusal of the office report is that by order dated 14.11.2014 of the Hon'ble Court, Mr. Rajan Narain, Ld. Advocate accepted notice on behalf of the respondents. By the same order the Ld. Counsel was given four weeks time to file the counter affidavit but he has failed to file the same. Viewed thus, the matter shall be processed for listing before the Hon'ble Court under the rules."

It is submitted for the information of the Hon'ble Court that there are seven respondents in the instant matter. Notice has been issued to Respondent Nos. 1 to 5 and 7 through Registered A.D. Post. Neither A.D. Cards nor unserved covers have been received back from Respondent Nos. 1 to 3 which are the state authorities so far. Respondent Nos. 4 and 5 are represented by Ms. Shirin Khajuria, Advocate and

Respondent No. 7 is represented by Mr. Rajan Narain, Advocate but no one has filed counter affidavit on behalf of their respective respondents so far.

It is further submitted that counsel for the petitioner has filed an application for deletion of the name of deceased Respondent No. 6 from the array of parties which has been registered as I.A. No. 1 and has already been included in the paper books.

Service of notice is not complete on Respondent nos. 1 to 3 which are state authorities and also on respondent No. 6 who has expired. An application for deletion of the name of the respondent No. 6 has been filed by the counsel for the petitioner.

The matter along with applications above mentioned is listed before the Hon'ble Court with this report.
