UPON hearing the counsel the Court made the following O R D E R
1 Though the parties were not successful in an earlier recourse to mediation under the auspices of the Supreme Court Mediation Centre, certain subsequent developments have taken place.
- 2 Pursuant to the order of this Court dated 18 August 2022, the petitioner and the child met the respondent and the grand-parents at Amloh in District Fatehgarh Sahib. Both Ms Sudershani Ray, counsel appearing on behalf of the petitioner and Mr P S Patwalia, senior counsel appearing for the respondent expressed the hope that the parties may be able to arrive at an amicable solution if a further attempt of mediation is made. The previous mediation was on a virtual platform during the pandemic.
- 3 The parties shall appear before a fresh Mediator of the Supreme Court Mediation Centre at 2 pm on 13 September 2022.
- 4 The petitioner as well as the daughter of the parties shall remain present before the Mediation Centre. The Mediator would allow the daughter to meet both the respondent and the grand-parents, if they are travelling with the respondent.
- 5 The expenses of the petitioner for her travel and stay in Delhi and incidental expenses shall be borne by the respondent. The payment shall be made by the respondent to the petitioner before the Mediator.
- 6 The Mediation Centre is requested to forward its report on the progress of the mediation to the Registry of this Court.
- 7 List the Transfer Petition on 10 October 2022.
