UPON hearing the counsel the Court made the following
O R D E R
It has been pointed out by learned counsel for the petitioner
that the State of West Bengal has issued some tenders for the supply of burnt mobile oil to keep the herd of elephants away by use of fire torches.
It is submitted by learned counsel for the State of West Bengal that fire torches are the only way to prevent the herd of elephants from causing damage. Without going into the correctness or otherwise of the submission, we would like the State of West Bengal to place on affidavit the name and designation of the person who will be responsible in each forest division in the event of mishap due to fire.
The concerned person will also file an affidavit that he will be responsible in the case of any mishap as stated by learned counsel appearing for the State of West Bengal.
Affidavit be filed within two weeks.
In the meanwhile, the tenders be not processed.
The learned ASG says that a meeting is scheduled on 01.12.2018 for instituting a task force or a steering committee as the case may be along with terms of reference.
The State of Odisha should file an affidavit within two weeks positively.
List the matter on 04.12.2018.
