UPON hearing the counsel through Video Conference, the Court made the following

SLP(C) Nos. 4410-4433/2020

Mr. Amalpush Shroti, Advocate for number of respondents filed counter affidavit alongwith IA for exemption from filing official translation. Said IA is defective. He failed to cure defects despite opportunities. Letter be issued in this regard.

Mr. M. E. Mazumdar, Advocate has filed only memo of appearance on behalf of respondent no. 5. He failed to file vakalatnama and counter affidavit despite opportunities.

However, as requested, learned counsel for petitioner to supply copy of petition to respondent no. 5 alongwith annexed documents within one weeks and file proof thereof. Thereafter, four weeks time, is granted to learned counsel to file vakalatnama and counter affidavit.

Appearing respondents, who have not filed counter affidavit, four weeks time, is granted to file the same.

List again on 01.11.2022.

Learned counsel for the petitioner has failed to take fresh steps and furnish fresh particulars in respect of unserved respondents. However, learned counsel for petitioner submits that some of the parties are State of Madhya Pradesh and some of the respondents are already represented through Counsels in connected matters.

With respect to the respondents already represented through the Counsels in the connected matters, service be effected through the said counsels and proof be filed within two weeks.

With respect to State of Madhya Pradesh, service be effected through Standing Counsel. Proof of service be filed within four weeks.

Served respondents, who have not filed counter affidavit, are granted four weeks, to file the same.

Learned counsel for petitioner has filed IA No. 120580/2022 for dispensing with service of notice in respect of respondent nos. 4 to 9 in SLP(C) Nos. 5636-37/2020. Same be placed before Hon'ble Judge-in-Chambers, for further directions.

Mr. Sidharth Jain, Advocate for Commissioner (Employee Provident Fund) filed vakalatnama. Same is defective, as he failed to cure defects, despite opportunities. Letter be issued to cure the defects and file counter affidavit within four weeks.
