UPON hearing the counsel the Court made the following O R D E R
The petitioners are aggrieved by non-grant of stay in considering the applications, being CM Appln. No. 26290/2023 and CM Appln. No. 26293/2023 filed by the petitioners before the High Court, while issuing notice on 18.05.2023. Thus, impugning the said order, these Special Leave Petitions have been filed.
In our view, the High Court has neither considered nor denied the interim relief. Therefore, we are not inclined to entertain these Special Leave Petitions.
As conceded by the learned senior counsel, on applying before the High Court during the course of the day itself requesting hearing of the application for stay, the High Court may be requested to consider the pending application and fix the case for consideration of the stay application in the next week.
In view of the aforesaid, the learned senior counsel appearing for the petitioners seeks leave to withdraw these Special Leave Petitions.
In view of above, the Special Leave Petitions are, accordingly, dismissed as withdrawn.
