It is submitted that the Mr. Surya Kant, Advocate has filed Application for impleadment as respondent which is registered as I.A No. 3 and was listed before the Hon'ble Court (In Chamber) on 20.9.2016 when the court was pleased to pass the following order:

" At the request, four weeks' time is granted to file Counter Affidavit in I.A No. 3 of 2016."

It is further submitted that Mr. Mukul Kumar, counsel for the petitioner did not file Counter Affidavit in I.A No. 3/2016 and the matter was lastly listed along with connected matters before the Ld. Registrar Court on 26.10.2016 when inter alia the following order was passed:

" The Ld. Counsel appearing for the petitioner submits that he does not wish to file counter affidavit in I.A. No.3/2016 in compliance of the order of the Hon'ble Court dated 20.9.2016, as such, Registry to process the said I.A. for listing before the Hon'ble Judge in Chambers.."

The application in the matter mentioned above is listed before the Hon'ble Court(In Chamber).
