UPON hearing the counsel the Court made the following O R D E R

SLP(C) No. 25298/2023

Respondent no.26 has been deleted from the array of parties vide Hon'ble Judge in Chambers order dt. 28.11.2024.

Service is complete on the remaining respondents.

Registry to process the matter for listing before the Hon'ble Court as per rules.

Respondent no.1 has filed counter affidavit.

Opportunity of respondent nos. 2, 4 and 11 to 17 to file counter affidavit has already been declined,

Respondent nos. 7 to 10 have failed to file counter affidavit despite last opportunity having been granted, as such, further opportunity stands declined.

Ld. counsel for the petitioner is granted two weeks' time to take fresh steps in respect of unserved respondent no.6. It has been submitted by the ld. Counsel for the petitioner that permission be granted to serve respondent no.6 also through the standing counsel of NCTE. Allowed. Particulars be filed within two weeks.

It has further been submitted by the ld. Counsel for the petitioner that both respondent nos.5 and 6 are concerned from the same department and service has been effected on respondent no.5. Submission is taken on record.

Service is complete on the remaining respondents but none has entered appearance.

Ld. Counsel for the petitioner has not filed affidavit alongwith proof of dasti service in respect of respondent nos.10 and 11 despite last opportunity having been granted, as such, Registry to process the matter for listing before the Hon'ble Judge in Chambers for necessary directions.

Ld. Counsel for respondent nos. 7 to 35 has submitted that counter affidavit has been filed. Registry to verify and update the records.

Respondent nos. 3 to 6 have failed to file counter affidavit despite last opportunity having been granted, as such, further opportunity stands declined.

Ld. Counsel for the petitioner has not filed affidavit alongwith proof of dasti service in respect of respondent nos.39,49 and 54 despite last opportunity having been granted, as such, Registry to process the matter for listing before the Hon'ble Judge in Chambers for necessary directions.

It has been informed by the ld. Counsel for the petitioner that vakalatnama has been filed on behalf of respondent nos. 1,4,5,6,7,9,10,11,12,13,14 and 15. Registry to verify and update the records. If vakalatnama has been filed, counter affidavit be filed within four weeks.

Ld. Counsel, Mr Arun Kumar appearing on behalf of Mr Rameshwar Prasad Goyal, Advocate-on-record undertakes to appear for respondent nos. 270 to 272 and seeks time to file vakalatnama and counter affidavit. Be filed within four weeks.

As per office report, ld. counsel for the petitioner has not filed spare copies in light of Hon'ble Court's order dt. 21.03.2025. Today more time is sought. One weeks time is granted

as last opportunity. If spare copies in respect of the remaining respondents are filed within the time granted, issue notices immediately and list again on 17.07.2025. If spare copies are not filed within the time granted, Registry to process the matter for listing before the Hon'ble Judge in Chambers for further directions.
