UPON hearing the counsel the Court made the following O R D E R
Whether the existing scheme of inspections by the Medical Council of India and manner of exercise of power by Central Govt. under Section 10-A of the Medical Council Act, 1956, require any modification in the interest of fairness and standards of non-exploitative and quality medical education is the core question in these matters. There is a further question of grant of interim orders by Courts for admissions and procedure for admissions under such interim orders, pending finalisation of issue of recognition/approval for admissions.
In our view, the matter out to be considered by a Bench of three Judges.
List in 2nd week of January, 2016, before a Bench of three Judges.
Since the questions relating to the manner of grant of admissions involved in R.P.(C)Nos.2159-2268/2013 & R.P.(C)Nos.2048-2157/2013 in T.C.(C)No.98,99,100,101,102, 103,104,105,107,108,110 & 111 of 2012, 112,113-114,115- 116, 117-118,119,120,121-122,123-124,125-127,128-130,131, 132-134 & 135-137 of 2012, 138-139,142,144 & 145 of 2012, 1,2,3,4,5 of 2013, 7,8,9,10,11,12-13,14-15,16,17,18,19, 20,21-22,23-24,25,30,53,58,59,60,61,62,72,73,75 & 76 of 2013, 28-29,31-32,33-36,37-38,39,40,41,42,43,44,45,46,47, 48,49,63-65,66-69,70-71,107 & 108 of 2013 Medical Council of India Etc. Vs. Christian Medical College, Vellore & Ors. Etc. and other connected matters may overlap, it will be appropriate that these matters are heard by the same Bench of three Judges, subject to orders of Hon'ble the Chief Justice of India.
Pleadings may be completed in the meantime.
