UPON hearing the counsel the Court made the following O R D E R
1 These proceedings under Article 32 of the Constitution have been instituted by post graduate doctors situated all over the country to challenge the change in the pattern for the ensuing NEET – Super Specialty examination which is due to be held on 13th/14th November 2021.
- 2 Mr Shyam Divan, learned senior counsel appearing on behalf of the petitioners submits that;
- (i) The notification announcing the dates for the examination was issued on 23 July 2021;
- (ii) On 31 August 2021, after the notification was issued, the pattern of the NEET – SS examination which prevailed from 2018-2020 has been altered;
- (iii) Under the prevailing pattern since 2018, 60% marks were to be allotted for questions in the Super Specialty while 40% marks were distributed to questions from the feeder courses;
- (iv) The example furnished in Annexure P-2 to the writ petition indicates that as a result of the new pattern, all questions for the Critical Care super specialty will be drawn from General Medicine, thereby leaving students from other specialties at a serious disadvantage; and
- (v) In any event, such a change ought not to have been made after the examination was notified and candidates have already commenced their preparations for the ensuing examination.
- 3 Issue notice, returnable on 27 September 2021.
- 4 Dasti, in addition, is permitted.
- 5 On the request of the learned senior counsel, we permit the petitioners to file brief notes of their written submissions together with any other additional documents that are sought to be relied on. These shall also be served on the respondents. In view of the urgency, a short counter affidavit be filed in the meantime.
