UPON hearing the counsel the Court made the following ORDER
These special leave petitions have been preferred with an preferred with an Hordinate delay of 339 days. There is not even a whisper in the application about the delay other than saying that it is inadvertent. This clearly falls within the category of cases where we have said that these are only filed to complete a formality of obtaining dismissal from this Court to save the concerned officers and no action is ever taken against the concerned officers for inordinate delay.
We have discussed this aspect in State of Madhya Pradesh & Ors. v. Bherulal [SLP (C) Dy.No.9217/2020], Deputy Conservator of Forests Vs. Timblo Irmaos Ltd. [SLP (C) Dy. No.19059/2020], State of Odisha & Ors. v. Sunanda Mahakuda [SLP (C) Dy. No.22605/2020] & The State of Uttar Pradesh & Ors. Vs. Shri Ram Jokhan Dhuria & Anr. [SLP (C) D. No.46625/2019] and thus categorized it as "certifiate cases". The fate must follow as in the other matters. The petitions are dismissed as barred by time. For wastage of judicial time, the petitioner(s) is imposed with costs of Rs.25,000/- to be deposited within Supreme Court Group 'C' (Non-Clerical) Employees Welfare Association within four weeks and a certificate of recovery be filed in the same time. The amounts be recovered from the officer(s) responsible for delay.
