The matters above-mentioned were listed before the Hon'ble Court on 15.03.2013 when the Court was pleased to pass the following Order:
"SLP(Crl.)....Crl.MPs.26637-38/2012
Applications for exemption from surrendering are rejected.
We further direct that the petitioners shall surrender before the concerned police authorities within a week's time from today and produce appropriate endorsement to that effect.
The Registry is directed to post this matter only such endorsement is filed.
List both the matters together."
It is submitted that in compliance of the Order quoted above, Counsel for the Petitioners has on 12.07.2013 filed custody certificates in respect of both the respondents in Special Leave Petition (Crl.) Nos. 5991-5992/2013 arising out of Criminal Miscellaneous Petition Nos. 26637-26638/2012 (copies enclosed).
It is further submitted that though both the petitioners Nos. 1 & 2 have surrendered on 11.2.2013 and 30.10.2012 respectively, Counsel for the Petitioners has filed custody certificates in respect of both the respondents only on 12.07.2013.
It is lastly submitted that there is delay of 13 days in refiling special leave petition and the same has been condoned by the Competent Authority.
The matters above mentioned are therefore listed before the Hon'ble Court with this office report.
