UPON hearing counsel the Court made the following O R D E R
This is an application praying for permitting the petitione r to serve notice on the
unserved respondent Nos. 19, 22, 32, 33, 50 and 53 by publication in ' Ananda Bazar Patrika' a nd
the 'Statesman' dailies which are stated to have wide circulation in the place of residence of the
respondents concerned.
Heard. I have also perused the application. The Hon'ble Court as per order dated
3.1.2006 granted six weeks time to the petitioner for the substituted se rvice on unserved
respondent. Having heard the learned counsel for the petitioner, I am satisfied that t he present
petition has been filed on the sole reason that notice could not be served on the above

respondents in the normal mode. In the said circumstances, I am inclined to allow this applica tion
with a further direction that the notice be effected by affixation in the last known address of the
respondents above mentioned as well. The process be given dasti to the petitioner who shall fi le
affidavit in proof of publication along with newspapers within four weeks. The process for aff ixation

shall be sent to the District Judge concerned. List after four weeks.
