Application for exemption from filing a certified

copy of the impugned judgment is allowed.

Delay condoned.

The prayer in the PIL filed before the High Court

was for quashing the approval granted on 17th September,

2019. From perusal of the impugned order, it appears to us that without examining the correctness of the said decision, on the ground that there is an approval granted on 17th September, 2019, the High Court has declined to entertain the PIL. Thus, the prayer made in the PIL has not been considered on merits.

Hence, issue notice returnable on 9th October, 2023.
