The matter above mentioned were listed before the Hon'ble Court on 12.09.2014, when the Court was pleased to pass the following order:-

"Delay condoned. Issue notice. Call on a non-miscellaneous day in the third week of November, 2014. Liberty is granted to the petitioners to file affidavit within two weeks. Reply thereto, if any, may be filed within two weeks thereafter."

It is submitted that pursuant to aforesaid order show cause notice to respondent No. 1 was issued through Ms. Rani Chhabra, Advocate and to respondent Nos. 2 to 44 was issued on 10.10.2014 by regd. A.D. Ms. Rani Chhabra, Advocate appearing for respondent No. 1 has also filed vakalatnama/appearance as well as counter affidavit on behalf of all the respondents. Counter affidavit has been included in SLP paper books.

It is further submitted that counsel for the petitioners has on 08.10.2014 filed affidavit and the same has been included in SLP paper-books. The Advocate for the respondents has not filed reply affidavit so far.

It is further submitted that Lrs. Of deceased respondent No. 5 have been brought on record vide order dated 01.12.2015 of Hon'ble Judge in Chambers. Accordingly, cause title has been amended and included in SLP paper books. Ms. Rani Chhabra, Advocate representing respondent Nos. 1 to 4 and 6 to 44 has filed vakalatnama/appearance on behalf of legal representatives of deceased respondent No. 5 but has not filed counter affidavit so far.

For non filing of counter affidavit on behalf of legal representatives of deceased respondent No.5 by the counsel appearing for the respondents, the matter was lastly listed before the Court of Ld. Registrar on 12.12.2016, when the following order was passed:-

"The respondent Nos. 1-4 and 6-44 have already filed the counter affidavit. Ms. Priyanka Sony, Ld. Counsel representing the respondent Nos. 5(i) and 5(ii) has stated that she does not intend to file the counter affidavit. This is taken on record. Viewed thus, the matter shall be processed for listing before the Hon'ble Court as per rules."
