RAMAKANTA NATH & ORS. Respondent(s)

( IA No.111336/2023-CONDONATION OF DELAY IN FILING )

Date : 03-07-2023 This petition was called on for hearing today.

CORAM :

HON'BLE MR. JUSTICE A.S. BOPANNA HON'BLE MR. JUSTICE M.M. SUNDRESH

For Petitioner(s) Mr. Sibo Sankar Mishra, AOR Mrs. Prabhati Nayak, Adv. Mr. Niranjan Sahu, Adv. Mr. Debabrata Dash, Adv. Ms. Apoorva Sharma, Adv.

For Respondent(s)

UPON hearing the counsel the Court made the following O R D E R

Delay condoned.

Heard the learned counsel for the petitioners.

We note, that this Court, through its earlier order dated 27.08.2021, had dismissed the Special Leave Petition. In that regard it was taken note that in the facts and circumstances of the instant case, there is no reason to interfere. That is for the reason, since the High Court had granted the relief only to the appellants therein. Digitally signed by Nisha Khulbey Date: 2023.07.03 16:10:33 IST Reason: Signature Not Verified

In that view, at this juncture, we see no reason to take a different view except to clarify that the benefit granted by the High Court only to the appellants therein, has constrained us not to interfere with the matter. However, if any other person seeks benefit of similarity of parity based on the said order, the same would be considered on its own merits and in accordance with law.

Petition is accordingly disposed of along with the pending application(s), if any.
