UPON hearing the counsel the Court made the following O R D E R
Delay condoned.
Issue notice.
Upon hearing learned Senior Counsel we are also inclined to grant a conditional stay of all further proceedings in Execution Case No.81/2023 in O.S. No.178/2005, on the file of the Court of the Principal Senior Civil Judge, Hubballi at Hubballi.
The learned senior counsel appearing the petitioner(s) submitted that the petitioner(s) may be permitted to deposit 25% of the cost awarded in R.F.A. No.100186/2016. However, we order that all further proceedings in Execution Case No.81/2023 will stand stayed on condition that the petitioner(s) deposits 50% of the amount remaining to be paid viz**., Rs. 61,59,730/- within eight weeks from today. The Executing Court on receipt of the said amount shall keep it in the interest bearing fixed deposit account for a period of six months.**
