UPON hearing the counsel the Court made the following O R D E R
- 1 A communication dated 28 February 2024 has been received from the Registrar General of the Gauhati High Court forwarding a letter dated 21 February 2024 of the Special Judge, CBI & NIA, Assam, Guwahati.
- 2 The letter of the Special Judge arises in the context of the order dated 25 August 2023 of this Court by which the Chief Justice of the High Court of Gauhati was requested to nominate one or more officers of the rank of Chief Judicial Magistrate and Sessions Judge in Gauhati, Assam to conduct all proceedings in connection with the investigation of cases relating to the violence in Manipur.
- 3 The Special Judge desires a clarification on two aspects, namely, (i) whether the trial should be conducted in the State of Assam after the filing of the charge-sheet; and (ii) the modalities to be followed in the case of an accused who is found to be a juvenile on the date of the commission of the offence.
- 4 Bearing in the mind the overall dimensions of the matter, we direct that an updated status report be filed before this Court within a period of two weeks by the State of Manipur as well as by the CBI & NIA in regard to the investigations. The status report shall indicate whether charge-sheets have been filed and, if so, in how many cases and the stage of the investigation in others.
- 5 A copy of the Twenty Eighth Report submitted by the Committed chaired by Justice Gita Mittal, former Chief Justice of the High Court of Jammu & Kashmir appointed by this Court, may be shared with the Attorney General for India. Attorney General states that he would take instructions specifically with reference to the incidents which have been highlighted in the report.
6 We direct that the proceedings be now listed before this Court on 1 April 2024.
