UPON hearing the counsel the Court made the following O R D E R
-
1 The Committee appointed by this Court has drawn the attention of the Court through counsel to the fact that there is a blockade at Moreh as a result of which food supplies cannot be delivered.

2 Ms Indira Jaising, senior counsel, in joining the request, submits that there is a serious risk of starvation as a result of the absence of food supplies. It has also been submitted that there is an outbreak of chickenpox in some of the relief camps.

3 Mr Tushar Mehta, Solicitor General, states that the Government of India and the Government of Manipur are aware of the situation and that adequate steps would be taken to ensure that the grievance in regard to the distribution of food supplies and essential medicines is duly met.

4 Some of the counsel, on the other hand, have also pointed out that the scarcity of food supplies is not only affecting Moreh, but also other parts of the State of Manipur, including National Highway-02, Kangpokpi, as a result of blockades.

5 We direct that both the Union Government and the State of Manipur shall ensure that supplies of food, essential medicines and other essential items continue to be distributed in the affected areas so that no part of the population suffers on account of the existing or apprehending blockades.

6 The manner in which the blockades should be dealt with is a matter for the law enforcement agencies to determine, bearing in mind all aspects of the humanitarian situation. The Government should explore all possible options, including the air dropping of food supplies, should it become necessary.

7 The Court should be apprised on affidavit by the Chief Secretary on the next date of listing of the specific steps taken to ameliorate the situation.

8 The Solicitor General seeks a short adjournment to take further instructions on the reports of the Committee, so that a statement can be made before this Court before the next date of listing.

9 The Solicitor General has informed the Court that a nodal officer each has been appointed by the State of Manipur and by the Union of India in terms of the previous order to facilitate the work of the Committee and a communication in that regard shall be provided to the Chairperson of the Committee within forty eight hours. The nodal officers shall act as the points of contact for facilitating the meetings and all other directions of the Committee being conveyed on the ground to the authorities concerned.

10 The Registry shall share soft copies of the fourth, fifth and sixth reports of the Committee with the Advocates-on-Record representing the parties in these proceedings. The reports should also be shared with the counsel instructing the Solicitor General of India.

11 A soft copy of the fourth report shall also be shared with the Secretary, National Legal Services Authority.

12 List the proceedings on 6 September 2023.

- 15 The IA is filed on behalf of the Scheduled Caste community in the State of Manipur, which is stated to be affected by the ongoing violence.
- 16 Mr Lalit Singh, senior counsel, states that as a part of the ameliorative and rehabilitative measures which are to be put in place in pursuance of the directions of this Court, this aspect may also be looked into.

- 18 We have heard Mr Huzefa Ahmadi, senior counsel, who appears in support of the petition which raises the issue of the destruction of 642 places of worship.

- 20 In the meantime, we permit the counsel, on his request, to circulate a note in regard to the grievance raised in the petition before the Committee appointed by this Court and the State Government so that appropriate action can be taken.

UPON hearing the counsel the Court made the following O R D E R
-
1 The Committee appointed by this Court has drawn the attention of the Court through counsel to the fact that there is a blockade at Moreh as a result of which food supplies cannot be delivered.

2 Ms Indira Jaising, senior counsel, in joining the request, submits that there is a serious risk of starvation as a result of the absence of food supplies. It has also been submitted that there is an outbreak of chickenpox in some of the relief camps.

3 Mr Tushar Mehta, Solicitor General, states that the Government of India and the Government of Manipur are aware of the situation and that adequate steps would be taken to ensure that the grievance in regard to the distribution of food supplies and essential medicines is duly met.

4 Some of the counsel, on the other hand, have also pointed out that the scarcity of food supplies is not only affecting Moreh, but also other parts of the State of Manipur, including National Highway-02, Kangpokpi, as a result of blockades.

5 We direct that both the Union Government and the State of Manipur shall ensure that supplies of food, essential medicines and other essential items continue to be distributed in the affected areas so that no part of the population suffers on account of the existing or apprehending blockades.

6 The manner in which the blockades should be dealt with is a matter for the law enforcement agencies to determine, bearing in mind all aspects of the humanitarian situation. The Government should explore all possible options, including the air dropping of food supplies, should it become necessary.

7 The Court should be apprised on affidavit by the Chief Secretary on the next date of listing of the specific steps taken to ameliorate the situation.

8 The Solicitor General seeks a short adjournment to take further instructions on the reports of the Committee, so that a statement can be made before this Court before the next date of listing.

9 The Solicitor General has informed the Court that a nodal officer each has been appointed by the State of Manipur and by the Union of India in terms of the previous order to facilitate the work of the Committee and a communication in that regard shall be provided to the Chairperson of the Committee within forty eight hours. The nodal officers shall act as the points of contact for facilitating the meetings and all other directions of the Committee being conveyed on the ground to the authorities concerned.

10 The Registry shall share soft copies of the fourth, fifth and sixth reports of the Committee with the Advocates-on-Record representing the parties in these proceedings. The reports should also be shared with the counsel instructing the Solicitor General of India.

11 A soft copy of the fourth report shall also be shared with the Secretary, National Legal Services Authority.

- 15 The IA is filed on behalf of the Scheduled Caste community in the State of Manipur, which is stated to be affected by the ongoing violence.
- 16 Mr Lalit Singh, senior counsel, states that as a part of the ameliorative and rehabilitative measures which are to be put in place in pursuance of the directions of this Court, this aspect may also be looked into.
- 17 A copy of the IA shall be served on Mr Raj Bahadur Yadav, AOR, instructing the Solicitor General and shall also be made available to the Committee chaired by Justice Gita Mittal.

- 18 We have heard Mr Huzefa Ahmadi, senior counsel, who appears in support of the petition which raises the issue of the destruction of 642 places of worship.
- 19 A copy of the petition shall be served on Mr Raj Bahadur Yadav, AOR, instructing the Solicitor General.
- 20 In the meantime, we permit the counsel, on his request, to circulate a note in regard to the grievance raised in the petition before the Committee appointed by this Court and the State Government so that appropriate action can be taken.
