UPON hearing the counsel the Court made the following O R D E R

Writ Petition (Civil) No 311 of 2023

• 1 Criminal Complaint No 8 of 2023 has been instituted against the petitioner in the Court of the Judicial Magistrate, Imphal East, Manipur for offences under Sections 153-A, 200, 295(A), 298, 505(i) and 120-B of the Indian Penal Code.
• 2 The Chief Judicial Magistrate directed the issuance of summons on 6 July 2023. On 10 July 2023, summons were issued to the petitioner.
• 3 Apart from the above criminal complaint, on 1 August 2023, the Chief Judicial

Magistrate, Imphal West has passed an order under Section 156(3) of the CrPC in Criminal Complaint No 02 of 2023. The allegation pertains to the enrollment of the accused in the electoral roll of Churachandpur Assembly Constituency commencing from the year 2005.

• 4 The petitioner is at liberty to seek appropriate reliefs, including anticipatory bail under Section 438 of the Code of Criminal Procedure 1973 (CrPC) before the competent court. The personal presence of the petitioner shall not be required before the competent court when the application under Section 438 of the CrPC is moved,
• 5 In order to facilitate the petitioner in seeking access to appropriate remedies available in law, we direct that for a period of two weeks from today, no coercive steps shall be taken against the petitioner.
• 6 This order shall not be construed as any expression of this Court on the merits and the competent court shall consider any application that may be moved by the petitioner without regarding this order as amounting to the expression of opinion on the merits of the issues sought to be raised.
• 7 The Writ Petition is accordingly disposed of.
• 8 Pending applications, if any, stand disposed of.
