UPON hearing the counsel the Court made the following O R D E R
The Court is convened through Video Conferencing.
Exemptions are allowed.
Heard learned counsel appearing for the petitioners, learned Additional Advocate General appearing for the State of Uttar Pradesh and carefully perused the record, including the counter affidavits filed by the State.
Taking into consideration the fact that the petitioner – Mr. Kali Charan @ Karuwa @ Ranjesh in Special Leave Petition(Crl.) No.5224/2021 and Petitioner – Puran in Special Leave Petition (Crl.) No.7985/2021 are reported to have been in jail for over 14 years and 9 months without remission and 11 years and 10 months without remission respectively, and their Criminal Appeals of the years 2009 and 2010, pending adjudication before the High Court of Judicature at Allahabad, are not likely to be taken up for final disposal very soon, which are facts that cannot be controverted by the learned Additional Advocate General appearing for the State of U.P, we are inclined to grant bail to them.
The petitioners are, therefore, directed to be released on bail, subject to such terms and conditions which the concerned Trial Court shall deem fit and appropriate to impose upon them.
The Special Leave Petitions are disposed of in the aforestated terms.
