UPON hearing the counsel the Court made the following O R D E R
It is pointed out that when the petitioner approached the High court, that matter was disposed of as the issue in question seeking to declare Section 212(6) of the Companies Act, 2013 as unconstitutional and to be not made applicable for offences under Section 448 of that Act along with
certain other Sections was pending before this Court.
The petitions are stated to be with the lead matter being Criminal Appeal No. 1269/2017. Thus this matter would have to be heard with that group.
It may be appropriate that this matter be heard by three Judges Bench, subject to orders of Hon'ble the Chief Justice of India.
Issue notice on the prayer for interim relief.
In the meantime, it is stated that the petitioner needs protection on account of the fact that he is a cancer patient and does not have any spleen. Thus the protection against arrest is granted in favour of the petitioner till the matter is taken up for hearing.
