The matter above mentioned was again listed before the Hon'ble Court on 22.01.2015 when the court was pleased to pass the following order:

"Admit. Hearing expedited. Rejoinder affidavit be filed within four weeks. Tag with Civil Appeal No. 8189-90 of 2011."

It is submitted that notice was issued on 01.02.2013 to both the respondents through registered A.D. Mr. Kumar Mihir, Advocate has on 08.12.2014 entered appearance on behalf of respondent no. 1 after obtaining NOC from Ms. N. Shobha, advocate and he has also filed counter affidavit. Duly signed A.D card has been received for respondent no. 2 but no one has entered appearance on his behalf so far. Service is complete in the matter. Counsel for the appellant has on 02.02.15 filed rejoinder affidavit. Original Record is not required in the matter vide Registry circular dated 03.12.14. No Statement of case has been filed by both the parties.
