UPON hearing counsel the Court made the following O R D E R
I.A. NO.6/2012 IN O.S. NO.3/2002
Mr. F.S. Nariman, learned Senior Counsel appearing for the State of Karnataka prays that hearing in the application may be deferred till 12th October, 2012, as he is expecting some orders by the Chairperson of the Cauvery River Authority (CRA) on the review petition filed by the State of Karnataka. He, however, apprehends that our order dated 28th September, 2012, passed in I.A. No.5 of 2012 in O.S. NO.3 of 2002, may come in the way of the Chairperson in taking a decision on the review petition.
Accordingly, while deferring hearing in the application till 12th October, 2012, we clarify that our order dated 28th September, 2012 shall not, in any way, be an impediment for the Chairperson to take a decision on the review petition, stated to have been filed by the State of Karnataka.
State of Tamil Nadu is permitted to file reply in this application within two days.
List the application on 12th October, 2012.
