It is submitted for information of the Hon'ble Court that the Special Leave Petition abovementioned is filed against the final judgment and Order dated 29th March, 2016 of the High Court of Gujarat at Ahmedabad in TA No. 286 of 2016 and is barred by time by 44 days. Counsel for the petitioner has filed application for condonation of delay in filing the special leave petition.

It is further submitted for the information of the Hon'ble Court that the Special Leave Petition No. 26781 of 2014 @ Special Leave Petition No...CC 16105 of 2014 entitled "COMMISSIONER OF INCOME TAXIV, AHMEDABAD vs OM PRAKESH R CHAUDHARY" arising from similar issue which was listed before the Hon'ble Court on 22nd September, 2014, when the Hon'ble Court has directed to issue notice. (Copy of order dated 22 nd September, 2014 is enclosed herewith for reference).

It is also submitted for the information of the Hon'ble Court that Counsel for the Petitioner has filed a letter dated 23rd August, 2016 stating therein that relied upon judgment in the case of CIT vs Om Prakash Chaudhary is under appeal before this Hon'ble Court in SLP No. 26781 of 2014. Hence, its filing may be dispensed with. Copy of letter dated 23rd August, 2016 is annexed at page no. 146 of paper books.

The matter alongwith application abovementioned is listed before the Hon'ble Court with this Office Report.
