It is submitted for information of the Hon'ble Court that the Special Leave Petitions abovementioned are filed against the final Judgment and Order dated 4th September, 2014 of the High Court of The State of Telangana and The State of Andhra Pradesh in ITTA No. 573 of 2014 and is barred by time by 86 days. The Counsel for the petitioner has filed Applications for condonation of delay in filing Special Leave Petitions.

It is also submitted for information of the Hon'ble Court that SLP (C) No. 11139 of 2014 @ SLP (C) No....CC 6186 of 2014 entitled "CITXIII vs RAJINDER KUMAR" arising from similar issue which was listed before the Hon'ble Court on 21st April, 2014, when the Hon'ble Court has directed to issue notice. (Copy of order dated 21st April, 2014, is enclosed herewith for reference).

It is further submitted that Office Report on default for not filing Additional documents as per undertaking letter was listed before the Hon'ble Judge in Chamber on 12th October, 2015 and 11th January, 2016, when His Lordship was pleased to pass the following order :

12 th October, 2015

"Learned counsel for the petitioner seeks two weeks time to file an application to the effect that the petitioner is not filing the additional documents.

Time, as prayed for, is granted.

11 Th January, 2016

"None present for the petitioner.

Delay of 25 days is condoned in filing an application for dispensing with the undertaking given by the petitioner."

The matter alongwith application above mentioned is listed before the Hon'ble Court with this office report.
