It is submitted for information of the Hon'ble Court that the Special Leave Petition abovementioned is filed against the final Judgment and Order dated 27th April, 2015 of the High Court of Judicature for Rajasthan at Jodhpur in TA No. 167 of 2014 and is barred by time by 23 days. The Counsel for the Petitioner has filed Application for Condonation of delay in filing Special Leave Petition.

It is further submitted for the information of the Hon'ble Court that Special Leave Petition No. 9904 of 2015 entitled "COMMISSIONER OF INCOME TAX vs HARISH CHAND AHUJA" arising from similar issue which was listed before the Hon'ble Court on 6th July, 2015, when the Hon'ble Court has directed to issue notice. (Copy of the Order dated 6th July, 2015 is enclosed herewith for reference.)

It is further submitted that Counsel for the petitioner has filed a letter dated 21st September, 2015 stating therein that Order dated 26th November, 2014 is not necessary as the same has already been challenged before this Hon'ble Court by filing SLP(C) No. 9904 of 2015. The Order passed in the said SLP is annexed as Annexure P5 at page nos. 118119 of the paper books.

The matter alongwith application abovementioned is listed before the Hon'ble Court with this office report.
