"Learned senior counsel for the appellant has invited our attention to the pleadings preferred by the appellant before the Karnataka Electricity Regulatory Commission at Bangalore wherein in paragraph 1.13 (Page 308 of the instant paperbook), it has been expressly asserted that despite the fact that an application was made for permission to transmit the additional electricity, the same was not granted. The above shows, that the finding recordeD in paragraph 24 of the impugned order, is wholly contrary to the record. Issue notice."

It is submitted that Notice was issued to all the four respondents on 25.08.2014 through registered A.D. Mr. Vikas Singh Jangra,advocate has entered appearance on behalf of respondent no. 1, 2 and 3 but has not filed counter affidavit so far. Duly signed A.D. card has been received from respondent no. 4 but no one has entered appearance on behalf of them. Service is complete on all the respondents.

The matter abovementioned is listed before the Hon'ble Court with this office report.
