Learned senior counsel for the appellant has invited our
attention to the pleadings preferred by the appellant before the Karnataka Electricity Regulatory Commission at Bangalore wherein in paragraph 1.13 (Page 308 of the instant paperbook), it has been expressly asserted that despite the fact that an application was made for permission to transmit the additional electricity, the same was not granted. The above shows, that the finding recorded in paragraph 24 of the impugned order, is wholly contrary to the
