parties to appear before the learned Single Judge for a fresh hearing. The learned counsel for the petitioner Sh. Manoj K. Mishra, apprehends that the observations of the Division Bench, while disposing of the appeal, may prejudice his case before the learned Single Judge. These apprehensions are not well founded, as they are not liable to be taken into consideration since the Division Bench itself has held that the matter has to heard afresh.
Liberty is also granted to the petitioner to move an interim application.
The special leave petition stands disposed of.
