UPON hearing the counsel the Court made the following O R D E R
I.A. No.78442/2024 and I.A. No.79861/2024
1. We have heard Mr. Abhishek Manu Singhvi, learned senior counsel on behalf of petitioner in support of prayer made in I.A. No.78442/2024 and Mr. Mukul Rohatgi, learned senior counsel on behalf of respondents in support of prayer made in I.A. No.79861/2024. We have also perused the supplementary documents which they have relied upon during the course of hearing.
2. In our considered view, there is no necessity to modify the directions contained in order dated 19.03.2024. Suffice it to reiterate that:
(i) The petitioner, his party's office bearers, workers and supporters shall abide by the directions contained in paragraph 3(iii) of the above mentioned order, in terms whereof the petitioner has been permitted to use the name "Nationalist Congress Party – Sharadchandra Pawar" with the "Man Blowing Turha" as the party symbol.
(ii) The petitioner will also ensure that his workers and supporters do not act in defiance to the directions referred to above and they do not use the symbol 'clock'.
(iii) Similarly, the respondents, their office bearers of the political party and the workers, are obligated to meticulously comply with the directions contained in paragraph 3 (vi) of the
2
above-mentioned order.
3. Mr. Mukul Rohatgi, learned senior counsel representing the respondents has very fairly agreed to issue the public notices with a more prominent place in the newspapers. He has also assured that the office bearers, candidates and supporters of the first respondent shall be sensitized to make sure that there is no violation or deviation of the directions issued by this Court vide order dated 19.03.2024.
4. In view of the above, both the Interlocutory Applications stand disposed of.
C.P.(C) Diary No.15310/2024
5. On the oral prayer of learned counsel for the respondents, the matter is taken on Board.
6. As of now nothing survives in the contempt petition, which is accordingly disposed of.
