The matters abovementioned were listed before the Hon'ble Court on 14th August, 2014, when the Court was pleased to pass the following order:

"Issue notice on special leave petitions as well as on stay".

Accordingly, show cause notice was issued to all the 5 respondents through Registered A.D. Post on 30th September, 2014. Mr. Irshad Ahmad, Advocate has on 13th November, 2014 filed Vakalatnama/Appearance on behalf of respondent Nos. 1 to 4 and on 18th November, 2014 filed Counter Affidavit on their behalf. The copy of the Counter Affidavit has been included in the paper books.

It is submitted that Office Report with regard to service position of notice in respect of respondent No. 5 was listed before the Ld. Registrar Court from time to time and again on 7th April, 2015 when the following order was passed:

"Service of respondent no. 5 is still awaited. The Ld. Counsel for the petitioner has requested to serve him by dasti mode as well. Notice be accordingly issued and proof of service be filed within 28 days of service. List again on 7.5.2015."

It is submitted that dasti notice was issued to the counsel for the petitioner for effecting service on unserved respondent No. 5 on 16th April, 2015. The counsel has on 7th October, 2015 filed affidavit of dasti service alongwith proof of service which shows that notice has been served on respondent No. 5 on 28th April, 2015 but no one has filed Vakalatnama/Appearance on behalf of the said respondent No. 5 so far.

It is further submitted that office report was lastly listed before the Ld. Registrar Court on 9 th October, 2015 when the following order was passed:

"Service upon respondent no. 5 is complete but none has entered appearance. Remaining all respondents are well represented on record. Their counter affidavit has already been filed.

Registry now to process the matter for being listed before the Hon'ble Court as per rules."

The matters are listed before the Hon'ble Court with this office report. Dated this the 19th day of November, 2015.
