The matter above mentioned was listed before the Hon'ble Court on 31st July, 2015, when the Court was pleased to pass the following Order:

"It is submitted by learned counsel for the petitioner that in respect of Survey No. 17 in Village Nanamava, the petitioner is in physical possession of 34702 Sq. Mt. of land but with regard to Survey No. 59 in the same village, the petitioner is in possession of about 9000 Sq. Mt. An area of about 10,000 Sq. Mt. is physically with the society which has made some construction thereon. Issue notice with regard to the physical possession of Survey No.17 and a part of Survey No.59 in Village Nanamava. Dasti, in addition, is permitted. The parties will maintain status quo as it exists today."

And lastly, the matter above mentioned was listed before the Court of Ld. Registrar on 27th November, 2015, when the following Order was passed:

"Respondent Nos.1 and 2 have already filed the counter affidavit. Service of respondent Nos.3 to 29 is complete but none has entered appearance. The petition now be processed to be listed before the Hon'ble Court, as per rules."

It is submitted for the information of the Hon'ble Court that there are twenty nine respondents in the instant matter. Respondent Nos. 1 and 2 are represented by Ms. Hemantika Wahi, Advocate and she has filed counteraffidavit on behalf of the said respondents which has been included in the paperbooks. Respondent Nos. 3 to 29 have been served as per proof of dasti service but no one has entered appearance on their behalf so far.

It is further submitted that counsel for the petitioner has filed the rejoinder affidavit with permission of the Hon'ble Court and the same has been included in the paperbooks.

Service of notice is complete.

The matter abovementioned is listed before the Hon'ble Court with this report.
